In-Person Training Terms

1. Scope

These In-Person Training Terms govern in-person services that D1 Performance LLC (“D1 Performance,” “we,” “our,” or “us”) delivers at a physical facility — evaluations, 1-on-1 sessions, and small-group training — where those services are available.

They are in addition to our Terms of Service, which govern the app and the online training service. Where these terms and the Terms of Service conflict on an in-person matter, these terms control. Purchasing the app or an online subscription does not include in-person training, and nothing here promises availability in any location.

2. Session Credits and Transportation Credits

In-person training is delivered through Session Credits and, where offered, Transportation Credits. Credits are purchased on our website, belong to the subject Athlete, and are governed by the specific offer terms — quantity, facility, and any expiration — shown at purchase.

Credits are not currency, carry no cash value, and cannot be transferred between Athletes except where we say otherwise in writing. Deleting the D1 Performance account that holds them ends access to them, as described in the Terms of Service.

3. Scheduling, cancellation, and no-shows

Sessions are scheduled through the Service. Late cancellations and no-shows may consume a Session Credit as described in the scheduling flow at the time of booking. We may reschedule or substitute a Trainer when necessary, and we will tell you when we do.

4. Parent/Guardian acknowledgments

A Parent/Guardian must provide the acknowledgments and consents we request before a minor Athlete participates in person, including transportation authorization where Transportation Credits are used.

The Parent/Guardian confirms that the Athlete is medically able to participate in strength and conditioning training, and agrees to keep emergency contact information current. We may decline or end participation in a session if a required acknowledgment is missing.

5. Facility conduct and health disclosure

Athletes must follow Trainer and facility instructions at all times, and must disclose relevant physical limitations, injuries, and medical conditions before participating and as soon as they arise. We may pause or end a session for safety. Facilities may impose their own rules, and those rules apply while on site.

6. In-person assumption of risk

In-person strength and conditioning training carries inherent risks, including muscle soreness, strains, sprains, more serious injury, and, in rare cases, catastrophic injury. Training in a shared facility adds risks that online programming does not, including contact with other athletes, movement around loaded equipment, and travel to and from the facility where Transportation Credits are used. Our training is technique-first and conservatively progressed, but no supervision can eliminate these risks.

To the fullest extent permitted by applicable law, by booking or attending an in-person session you — and, for a minor Athlete, the Parent/Guardian authorizing that participation — acknowledge these inherent risks and voluntarily accept them. The general physical activity terms in our Terms of Service also apply, including the expectation that the Athlete obtains a physician’s clearance where there is any doubt about their health, trains within their ability, and stops immediately and seeks qualified medical care for sharp pain, dizziness, chest pain, numbness, swelling, or anything that feels wrong.

Nothing in this section limits rights that applicable law does not allow to be limited, including protections some states provide to minors. This section does not waive claims arising from our own negligence or misconduct where such a waiver is not permitted.

7. Area requests

“Request D1 in your area” submissions are interest signals only. They are not bookings, purchases, or promises of availability in any location.
